CNIPA released the White Paper for China's 2023 IP protection status
Recently, the "2023 China Intellectual Property Protection Status" white paper (hereinafter referred to as the "white paper") was officially released.
The white paper outlines the progress and achievements in China's intellectual property (IP) protection in 2023 across five aspects: protection effectiveness, system construction, examination and registration, cultural development, and international cooperation.
In terms of protection effectiveness, the efficiency of judicial and administrative protection continues to improve.
Courts across the country accepted 462,200 new first-instance civil IP cases, the national procuratorial organs handled 7,049 cases involving the review and approval of arrests for IP infringement, and public security organs nationwide registered 40,000 cases of IP infringement and the production and sale of counterfeit goods.
Several administrative enforcement campaigns focusing on key areas and critical links were organized. In 2023, public satisfaction with China's IP protection increased to 82.04 points, a new record high.
Regarding system construction, the IP legal system has been continuously improved. Over the year, about 20 IP laws, regulations, and rules were formulated or revised, 2 judicial interpretations related to IP protection were created or refined, and around 30 normative and policy documents on IP protection were issued. Positive progress was made in local comprehensive legislation.
In the area of examination and registration, the number of IP approvals and registrations continued to grow.
By the end of 2023, China had 4.9906 million valid invention patents, an 18.5% increase year-on-year. There were 46.1464 million valid registered trademarks, up 8.1% year-on-year. The total number of annual copyright registrations was 8.9239 million, a 40.46% increase year-on-year.
A total of 2,508 geographical indication products were approved for protection. In 2023, 14,278 applications for new plant variety rights in agriculture were received, a 27.5% increase year-on-year, and 1,906 applications for new plant variety rights in forestry and grasslands were received, with 915 granted.
In terms of cultural development, efforts continued to tell the story of IP, deepening the cultural concept of IP. Policy briefings on significant events, such as the release of the implementation rules for the newly revised Patent Law, were held at the State Council Information Office.
Eight reports related to IP protection, including the "2022 China Customs Intellectual Property Protection Status," were released, and multiple departments published annual typical IP protection cases.
On the international cooperation front, China actively participated in global IP governance, promoted consultations on the Design Law Treaty and the diplomatic conference on IP and genetic resources, diligently implemented the "China-EU Agreement on Geographical Indications," and held events marking the 50th anniversary of cooperation with the World Intellectual Property Organization (WIPO).
Cooperation with customs authorities in the EU, Russia, Japan, South Korea, and other countries (regions) was continuously strengthened.
Since 1998, China has been releasing annual white papers on IP protection status for over 20 consecutive years, establishing these reports as authoritative materials that showcase the Chinese government's firm stance on stringent IP protection and help domestic and international communities understand the state of IP protection in China.
