Champion wins 600,000$ against 6 counterfeiters in China

 

The year 2021 started with the well awaited victory of Hanesbrand Inc. against six defendants, in between of individuals and companies, in regards of a trademark infringement against the Hanesbrand's main brand “Champion”.

Even if the Nanjing Intermediate People’s Court did not publish yet the judgement file on the official website, the notice of the victory is already all over the news.

Indeed, Hanesbrand Inc. is a global leading company in the field of sportwear and basic apparel in America, Europe and Asia-Pacific countries.

The company’s products are mainly t-shirt, sportswear, shapewear and underwear under well-known apparel brands such as Hanes, Playtex, Lovable, Wonderbra and its most popular and appreciated Champion, which is also the main character of this dispute.

The case began months ago with a major operation to prevent counterfeit production and trade of fake "Champion" clothes. The identified defendants behind this big infringement operation are six: Hurricane, Chengda, Rainbow Wing, Fuxun, Yunma, and Wu Zhanghao, who sell all the counterfeited products in retail outlets around China.

On January 5th, 2021 the Nanjing Intermediate People’s Court announced a favorable decision towards the American company against the involved trademark infringement and counterfeited actions.

The defendants, Hurricane, Chengda, Rainbow Wing, Fuxun, Yunma and Wu Zhanghao, were ordered to immediately cease all infringements of the Champion brand. The defendants were also ordered to pay an amount higher than $600,000.

“The case marks a significant victory for the Champion brand,” said Jon Ram, CEO of Hanesbrand: “We will continue to aggressively defend our intellectual property in China and around the world.”

This can be considered a great victory for Hanesbrand, but it also signed a first great result and victory for Chinese intellectual property system since the publication, on December 10th, 2020, of the “Guidelines for Enforcement of Intellectual Property Judgments” (知识产权判决执行工作指南) by China’s Supreme People’s Court; which aimed, with 29 Articles, to increas and empower intellectual property in civil, administrative and criminal cases.
